1. Nature of the Service

CrowdPinch (crowd-pinch.com) is an informational platform that estimates crowd levels from historical visitor patterns, usual opening hours and, where available, recent reports submitted by independent users ("Contributors"). Crowd levels, best times and opening hours are estimates: they do not represent an official, verified, or certified measurement of any kind, and opening hours may differ from those set by each attraction on any given day.

CrowdPinch makes no warranties, express or implied, regarding the accuracy, completeness, timeliness, reliability, or fitness for a particular purpose of any crowd-level report. Data may be outdated, incomplete, biased, or entirely inaccurate. By using this service, you expressly acknowledge and accept that you rely on all data entirely at your own risk. CrowdPinch shall not be held liable for any itinerary, travel, or purchasing decision made based on the platform's crowd indicators.

2. Third-Party Affiliate Disclaimer

CrowdPinch does not sell, issue, or manage tickets, tours, skip-the-line passes, or any other travel product. Certain buttons and links on the platform are affiliate links to third-party providers (currently GetYourGuide and Booking.com, the latter through the CJ Affiliate network). CrowdPinch may receive a commission when you complete a purchase through these links.

• Any claim related to ticket availability, pricing, cancellations, refunds, or service quality must be directed exclusively to the third-party provider where the transaction was completed.
• CrowdPinch is not a party to any commercial agreement between the user and any third-party provider and expressly disclaims all liability arising from such transactions.
• External links open in a new window. CrowdPinch does not control, endorse, or assume responsibility for the content, privacy practices, or reliability of any third-party website.

3. Limitation of Liability

To the maximum extent permitted by applicable law, CrowdPinch, its owners, developers, contributors, and affiliates shall not be liable for any damages of any kind arising from or in connection with your use of the platform, including but not limited to:

• Direct, indirect, incidental, punitive, or consequential damages;
• Loss of profits, revenue, data, or goodwill;
• Travel disruptions including missed flights, trains, reservations, or pre-purchased tickets;
• Physical harm, safety incidents, or personal injury at any attraction;
• Monetary loss resulting from reliance on inaccurate crowd-level data.

This limitation applies regardless of the legal theory under which the claim is brought and even if CrowdPinch has been advised of the possibility of such damages. Your sole remedy for dissatisfaction with the service is to stop using it.

4. Acceptable Use Policy

By submitting crowd-level reports, you represent that your reports are made in good faith and reflect your genuine, real-time observation. The following activities are strictly prohibited:

• Using automated bots, scripts, crawlers, or any programmatic means to submit reports;
• Coordinating with other users to deliberately manipulate crowd-level indicators;
• Submitting false, misleading, or commercially motivated reports to influence user behavior;
• Attempting to reverse-engineer, scrape, or exploit the platform's data infrastructure;
• Any use that disrupts the integrity, availability, or trustworthiness of the platform.

CrowdPinch reserves the right to block IP addresses, rate-limit submissions, or discard reports suspected of bad-faith conduct at its sole discretion, without prior notice and without liability to the affected user.

5. Service Modifications & Governing Law

The platform is provided on an "as-is" and "as-available" basis without any representations or warranties of any kind. CrowdPinch reserves the right, at its sole discretion and without notice, to:

• Modify, suspend, or permanently discontinue any feature or the entire service;
• Update these Terms at any time; continued use constitutes acceptance of the revised Terms;
• Change affiliate partnerships, monetization methods, or data sources.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the platform owner is legally registered. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction. If any provision is found unenforceable, the remaining provisions continue in full force.

6. Privacy & Data

CrowdPinch does not require user registration and does not ask for your name or email. A crowd report stores only the chosen level and the time it was sent.

• Analytics: the website uses Google Analytics 4 to measure aggregate use (pages viewed, buttons clicked, approximate country and device). Google may set cookies or similar identifiers in your browser. You can block them in your browser settings or with Google's opt-out add-on (tools.google.com/dlpage/gaoptout).
• Hosting and security: the site runs on Cloudflare, which processes technical data such as IP addresses to deliver pages and block abuse.
• Affiliate links: once you leave CrowdPinch through an affiliate link, the third-party provider's privacy policy applies.

We do not sell personal data to third parties.

7. Embeddable Widget

CrowdPinch offers a free widget that third-party websites ("Publishers") may embed with the code provided at crowd-pinch.com/widget/. By embedding it, the Publisher accepts these Terms, including this section.

• No guarantee of availability. The widget is provided free of charge, "as is" and "as available". CrowdPinch may change, limit, suspend, or permanently discontinue the widget, any embed address, or the whole service at any time, with or without notice. When that happens, the embedded frame may show a notice, show nothing, or stop loading.
• No liability to Publishers. CrowdPinch is not liable for any loss arising from the widget or its interruption, including loss of traffic, revenue, commissions, or rankings, or effects on the Publisher's page layout. Using the widget does not create any partnership, agency, or contract for services between CrowdPinch and the Publisher.
• Custom versions. The free widget shows crowd information only. Versions with a booking button or with a Publisher's own branding or links are only available by separate agreement with CrowdPinch.
• The Publisher's responsibility. The Publisher is responsible for its own website and content and for complying with the advertising and disclosure rules that apply to it.
• Fair use. Keep the attribution line ("Crowd data: CrowdPinch") and do not alter the widget so that its data appears official or your own. Do not embed it on pages with illegal, hateful, or adult content. CrowdPinch may stop serving the widget to any website at its discretion.
• Privacy. The widget does not use analytics or cookies. It loads its data from crowd-pinch.com, so visitors' browsers connect to CrowdPinch and Cloudflare when the widget is shown.

8. Governing Language

These Terms of Service are drafted and executed in the English language. Any translation of these Terms into any other language is provided solely for the convenience of the user, and the English version shall control and prevail in all respects, including any disputes or interpretations.
